A LANDSCAPE gardener who pleaded guilty to animal cruelty by not bringing his family pet to a vet will not receive a conviction if he pays €1,000 to the Dublin Society for the Prevention of Cruelty to Animals.
Garda Paraic Clancy told Tallaght District Court that on June 29th, 2010, he came across a 14-year-old cocker spaniel in Firhouse with a large external tumour. He brought the dog to the DSPCA, who later put it down.
Garda Clancy said the dog belonged to Kevin Magill.
Mr Magill (53), Woodlawn Park, Firhouse, pleaded guilty to animal cruelty by failing to bring his spaniel to a vet despite it having an external tumour at his address on the above date.
Michael Hennessy, for the defendant, said his client had €500 in court and would be willing to pay it to the named animal charity in lieu of a conviction.
Judge David McHugh said he would need €1,000. He adjourned the case to a date in July for payment of the amount to the charity. If it is paid, the Probation Act will be applied.
