A POLISH national, who faces serious criminal charges and who broke a curfew imposed as a condition of bail, was sent back to prison by the High Court yesterday.
Mr Justice Paul Gilligan heard that Wojciech Bobowicz, of Waterville Road, Blanchardstown, Dublin, had been found with a screwdriver in his pocket at four in the morning.
Garda Joseph McLaughlin said Mr Bobowicz faced charges alleging false imprisonment, sexual assault, possession of a weapon and the unauthorised taking of a car. He told Ms Sinead Mc Mullan, counsel for the State, that gardaí had apprehended Mr Bobowicz in a car.
Garda McLaughlin said that, on August 26th, Mr Bobowicz had been granted bail by the High Court on a number of conditions, including that he lived with his parents at Waterville Road, Blanchardstown, and observed a daily curfew between 9pm and 7am. Garda Donna Walsh said Mr Bobowicz's mother, who with her husband had undertaken €1,200 surety for her son's release on bail, had complained at Blanchardstown Garda station that her son had breached his bail conditions by leaving the family home shortly after 3am.
Garda Walsh said she had stopped Mr Bobowicz in Main Street, Blanchardstown, at 4am and had taken him to the Garda station where he was searched and a small screwdriver was found in his pocket.
Tom Neville, counsel for Mr Bobowicz, said he had to inform the court that the parents no longer wished to remain as sureties for their son as they were unable to control his movements. They no longer wished to allow him to reside in their home.
Mr Bobowicz said in evidence he had gone to an all-night shop for a bottle of coke and to buy credit for his mobile phone.
Judge Gilligan said Mr Bobowicz was facing very serious charges and, while he accepted he had not been threatening anyone when taken into custody by gardaí, he was clearly in breach of his High Court bail conditions.
His explanation to the court held no weight and he had no option but to revoke his bail and remand him in custody to Cloverhill District Court on September 2nd.
