Morris tribunal:The tribunal will consider immediately whether to ask the High Court to compel Raphoe man Frank McBrearty to give evidence, after the publican again failed to appear as scheduled yesterday morning to testify.
Barrister Paul McDermott SC said that "despite all the promises and undertakings by Mr McBrearty that he would attend at the tribunal and complete his evidence", the publican was "not willing to humour that obligation and undertaking".
The tribunal chairman, Mr Justice Frederick Morris, said he was disappointed at the way Mr McBrearty had treated the tribunal and wanted to take the opportunity to express his disapproval at how tribunal counsel and staff had been treated.
Staff had spent many hours with Mr McBrearty preparing material and in consultation with him to do full justice to his case, he said, because Mr McBrearty had no legal representation before the inquiry.
The chairman said he would consider immediately whether to ask the High Court to compel Mr McBrearty to appear before him.
