A 12-year-old boy suffering from cerebral palsy who is alleging negligence in the circumstances of his birth at a Cork hospital was in a healthy condition when delivered, the High Court was told yesterday.
Ward Sister Marion Kelly, a midwife, said Ian O'Mahony's post-birth condition was recorded as eight out of a possible 10.
That was an indication of a very healthy baby.
Giving evidence on behalf of the Bon Secours hospital, Cork, Ms Kelly said that, although she was on duty at the hospital on the day of Ian's birth on May 11th, 1987, she had no recollection of the mother or the delivery of her child.
Yesterday was the 25th day of the action in which Ian, through his mother, Mrs Ann O'Mahony, of Beechwood Grove, Onslow Gardens, Commons Road, Cork is suing the hospital and a consultant obstetrician, Dr David A. Corr.
All claims of negligence are being denied both by the hospital and the doctor.
The court has heard that Ian suffers from cerebral palsy, is quadriplegic, has severe mental and physical handicap and needs constant care and attention.
The hearing before Mr Justice Quirke continues today.
