A leading building materials company accused of causing defects in hundreds of north Dublin homes has asked the Commercial Court to declare a mistrial in the case.
The Lagan Group, which is accused of supplying defective infill which caused the problems, yesterday began a court action to have the long-running case taken by Menolly Homes and other companies owned by developer Séamus Ross struck out.
Lawyers for the Lagan companies argue that Menolly’s production of documents in the case is defective and that documents disclosed after the case raise questions about Menolly’s building practices.
