The High Court yesterday granted the mother of an uncontrollable 14-year-old boy permission to seek a judicial review of the Minister for Education's failure to provide appropriate education facilities for her son.Last December the court had refused to give her leave to seek a review and held the Minister had been given little more than a fortnight to provide such facilities. On December 23rd Mr Justice Quirke had criticised the mother's application simply to put pressure on the Minister to provide instant facilities. He had been told the Dublin boy was beyond the control of his mother, had been the subject of an out-of-control order under the Children's Act and had been placed in St Laurence's Special School, Finglas.On December 4th the principal of the school had contacted the welfare authorities to report the boy was now beyond the control of the school authorities and was therefore expelled.Yesterday Mr Gerard Durcan SC, for the mother, told Mrs Justice McGuinness that following the refusal by Mr Justice Quirke he (Mr Durcan) had advised that a letter be sent to the Minister and health board giving them further time to deal with the problem.Mr Durcan said another five weeks had gone by and nothing had happened.Mrs Justice McGuinness said a prima facie case had been made out and she would grant leave to seek a judicial review.
