A VERDICT is to be given in December in relation to a case taken by the Health Service Executive against a nursing home in which a patient died after swallowing latex gloves.

The HSE has taken the action against Waterford Nursing Home at Ballinakill Downs, run by Mowlam Healthcare in Waterford, in relation to the death of James “Hymie” Griffin (67), Cannon Street, Waterford, who died on November 13th, 2008.

Mowlam is accused of a breach of nursing home regulations and of failing to provide sufficient care to Mr Griffin. Closing arguments were heard yesterday at Waterford District Court.

The HSE said Mr Griffin, who had Alzheimer’s disease, should not have been able to gain access to the gloves.

Counsel for Mowlam, Shay Fleming, told Judge David Kennedy that nobody had given any evidence of where the gloves actually came from.

The judge adjourned the matter to December 5th for a decision.
