The parents of a young man who died after he was allegedly shot by gardai during a robbery have been given leave to challenge a Dublin City Coroner's decision to grant certain gardai anonymity when they give evidence at an inquest into the death.
Ms Ann and Mr John Morris of Tymon North Green, Tallaght, Dublin, parents of the late Mr John Morris Junior, also secured leave to challenge the coroner's decision to exclude certain aspects of the forensic and ballistic reports to be presented to the inquest. The coroner has ruled that identification numbers which would identify the weapons used in the shooting and the identity of witnesses who are members of the Garda should be excluded from the reports.
Mr Justice Geoghegan further granted Mr and Mrs Morris a stay preventing the inquest going ahead pending a determination of their High Court proceedings.
In an affidavit, Mr Greg O'Neill, solicitor, said the application for leave to challenge the coroner's decision by way of judicial review arose out of decisions made by the coroner on September 10th and October 28th last regarding procedures for the holding of the inquest into the death of Mr John Morris Junior.
It is alleged Mr Morris Junior was shot by Garda members at the premises of Newspread, Goldenbridge Industrial Estate, Inchicore, Dublin on June 4th 1997. He died from his injuries the following day.
