A Croatian prostitute has alleged a Waterford man claiming to be a garda raped her in a hotel and threatened to throw her out the window before leaving with €1,200 of her money.

The 46-year-old man has pleaded not guilty to raping the woman in a Waterford hotel on May 21st, 2006, and to stealing the cash from her on the same occasion.

She told prosecuting counsel, Gerard Clarke SC (with Michael Delaney), she was only in Ireland four days and had booked into the hotel to work for the Red Velvet Escorts agency when the man was sent up to her room.

She said they agreed he would pay €150 for half an hour of "regular sex with a condom, no kissing, no licking". She said soon after they began, he became aggressive and tried to kiss her, despite her saying "please, no".

She alleged he then grabbed her by the throat and demanded she take the condom off. She said when she refused, he took it off himself. She said he warned her not to say anything or "he would throw her out the window". She told Mr Clarke that once he finished having sex, he got dressed and went through her bag, taking €1,050 and the €150 he had given her. Before he left, he said: "I'm the guards, you're f**ked up."

She said she immediately locked the door and called the Cork-based escort agency to report what happened. Gardaí arrived and took her to hospital.

Asked by Mr Clarke would she ever have sex without a condom, she replied: "No, because I'm too scared of diseases and pregnancy." She denied the suggestion by defence counsel, Hugh Hartnett SC (with Philipp Rhan), that once sexual intercourse began, they discussed how much it would cost to have sex without a condom and she told him it would be "another three or four hundred". Mr Hartnett suggested they agreed on €200, but when the sex was over he left only €100 and she became very upset and threw a hairbrush at him.

She told Mr Hartnett there was "no discussion about sex without a condom" and denied the accused left her any "extra" money. She agreed some escort workers had a "menu" and customers could pay extra for not using a condom or kissing, but that this didn't apply to her.

She agreed the man had "a large roll of fifties" when he arrived, but insisted that he had stolen from her.

She said she had arrived in Ireland on May 17th, 2006, but had been in the country before and had worked as a prostitute for two months in total. She said she had an arrangement with the agency where a customer would call them and they would send them up to her hotel room.

She told Mr Hartnett the agency would keep half the money. The trial continues before Mr Justice Barry White and a jury of six men and six women.
