An anaesthetist who ended up in a cell in a Garda station following an alleged "after hours" dispute at a pub he owns in Wexford is suing two gardai and the State claiming false and wrongful arrest and defamation, the High Court was told yesterday.
Ms Justice Macken said she would give her decision within the next two weeks on an application by Mr Donal Logue, Swan View, The Faythe, Wexford, to see documents in the State's possession.
Mr Logue claims his lawyers require certain documents from the State to prepare for his action. The judge is to examine a number of documents to decide if they are privileged.
Mr Logue has brought his action against Sgt Daniel Redmond and Garda Gerard Kealy, of Wexford Garda station, and the State.
Mr David Kennedy, for Mr Logue, said his client owned the Kingdom Bar, South Main Street, Wexford. On June 20th, 1993, gardai had attended at Mr Logue's pub after closing time. An incident took place, Mr Logue was arrested and taken to the local Garda station and detained. Mr Kennedy said the gardai and the State denied Mr Logue's claims.
Mr Kennedy said there had been a prosecution in the District Court and Mr Logue had been fined £60.
