A SOLICITOR has brought a High Court challenge to a finding by a Law Society committee that he provided inadequate professional services arising from his administration of the estate of a deceased client.
John F Condon of McMahon and Tweedy, Merchant’s Quay, Dublin, was the sole executor of the will of the deceased client and had control of disposal of the main asset, the family home in Terenure, Dublin, which was sold for €975,000 in 2007.
The will stipulated that the proceeds of the estate be divided equally between the deceased’s five children.
Two of the children later complained to the Law Society about Mr Condon’s handling of the administration of the estate. It found that Mr Condon provided an inadequate professional service to those children, the court heard.
Mr Condon then brought High Court judicial review proceedings seeking to quash this finding and also challenging orders requiring him to hand over his files on the matter to another solicitor and pay €1,500 towards the society’s costs.
The case concluded yesterday before the president of the High Court, Mr Justice Nicholas Kearns, who reserved judgment.
