A 57-year-old solicitor appeared in court in Limerick yesterday charged with deception.
Denis McMahon, with an address at Pembroke Road, Dublin, is charged that on or about November 27th, 2002, he did dishonestly and by deception induce a woman to hand over a bank draft for €7,500 with the intention of making gain for himself or another.
The alleged offence, contrary to section 6 of the Criminal Justice (Theft and Fraud Offences) Act is alleged to have taken place at the offices of McMahon O’Brien Downes Solicitors, Henry Street, Limerick.
Det Garda Margaret Nagle of Henry Street Garda station gave evidence of arresting and formally charging Mr McMahon at the station on September 1st last.
The court heard that Mr McMahon made no reply to the charge.
Insp Jerry Horan said the Director of Public Prosecutions had directed that the case be dealt with on indictment and that there was no objection to bail.
Defence barrister Brian McInerney told the court the matter would be “vigorously and fully contested and defended”.
Judge Eamon O’Brien remanded the accused on continuing bail and adjourned the case until November 23rd next for service of the book of evidence.
