A Limerick solicitor has filed a complaint to the Garda Complaints Board after gardaí attempted yesterday to prevent him serving a summons on the Taoiseach, Mr Ahern.
The summons relates to a case against two members of the Catholic Worker movement, who have been charged with trespass and criminal damage during an anti-war protest at Shannon Airport last month.
They are being represented by solicitor Mr John Devane who said he had been instructed to question the Taoiseach about the Government's stance on the Iraqi war and its implications for Irish neutrality. Mr Ahern is expected to take legal advice from the Attorney General, Mr Rory Brady, on the matter.
However, Mr Devane said the Taoiseach's office would not confirm yesterday that the summons had been received.
A Government spokeswoman could not confirm whether anyone in the office had spoken yesterday to Mr Devane. She said the Government Press Office had confirmed on Wednesday night that a subpoena had been received and was happy to restate the point last night.
