Summonses against a doctor and two other defendants relating to the unauthorised sale or supply of medicines have been reissued and re-served.
A total of 59 summonses against the three were struck out last month when the Irish Medicines Board (IMB) failed to appear to prosecute the case at Tralee District Court.
The summonses relate to the sale or supply of medicinal products - many prescription-only medicines - without a licence or necessary authorisation from the IMB.
There are 25 summonses against Dr Paschal Carmody, of Ballycuggeran, Killaloe, Co Clare; 25 against Lyntondell Ltd, trading as Daly Nutritionals, Foynes, Co Limerick, and Bawnboy, Ballyroe, Tralee; and nine summonses against Séamus Kane, also of Bawnboy.
Tralee District Court office yesterday confirmed it had authorised the reissuing of the summonses by the board.
Solicitor for the defendants John Devane said the summonses had been served with exactly the same charges listed.
He would be seeking a judicial review in the High Court of the reissuing of the summonses in the case of all three defendants before September 28th, the date for the summonses to come before the court in Tralee. He accused the board of wasting taxpayers' money, and said it was conducting a witch hunt against his client, Dr Carmody.
A special day had been set for the cases to be heard on July 18th. Two days later, the IMB failed to have the cases re-entered.
Judge James O'Connor rejected arguments by the board in statements to the media that it had not been made aware of the court date. He said the date had been fixed in open court, and it was not up to the District Court office to inform the prosecutor in criminal cases.
