The Taoiseach has provided information in writing to the tribunal on foot of requests but no statement has been given, the tribunal was told.

Mr Pat Hanratty, counsel for the tribunal, said it wished to correct the impression given in evidence by the Minister for Social, Community and Family Affairs, Mr Dermot Ahern, that the Taoiseach had provided a statement.

"The position is that in the course of its ongoing inquiries the tribunal sought information from a number of people including the Taoiseach and the information which was sought from the Taoiseach was provided to the tribunal, and that was done in correspondence, not in a statement", said Mr Hanratty.

At the close of Mr Dermot Ahern's evidence, Mr John Fox SC, for Mr Ray Burke, said he might wish to recall the Minister due to matters which arose under cross-examination.

He said these matters were not covered by Mr Dermot Ahern's statement, which had been circulated prior to him giving evidence. Mr Fox had earlier said it was not his intention to cross-examine Mr Dermot Ahern.

Mr Justice Flood said the sequence of witnesses had been signalled for some time past. The chairman said, however, he would consider a submission requesting the recall of the Minister if it was based on specific matters which were raised for the first time during Mr Dermot Ahern's cross-examination.
