The third interim report of the planning tribunal formerly chaired by Mr Justice Flood will be given to both houses of the Oireachtas tomorrow.
The Clerk of the Dáil, Mr Kieran Coughlan, received the report yesterday but delayed circulating it until receiving direction from the High Court.
But he issued a short statement this evening saying he is satisfied that section 3 of the Tribunals of Inquiry Act does not apply and thata recourse to the court is not necessary.
The third report deals with testimony given by former assistant Dublin city and county manager, George Redmond (79), who was jailed for a year recently on planning corruption charges.
Redmond, the 79-year-old former assistant Dublin city and county manager, is currently serving a 12- month sentence in Cloverhill Prison on corruption charges unrelated to the tribunal's investigation.
He is also facing two charges relating to his role in the compulsory purchase of two properties in west Dublin by the council in the 1980s.
The report, which is expected to be highly critical of him is expected to be sent to him in prison.
The report is the work of Mr Justice Fergus Flood who has now been succeeded as chair of the tribunal by Judge Alan Mahon. Legal proceedings against Redmond held up its release.
The tribunal took evidence from Redmond in 1999 under the chairmanship of Mr Justice Flood about large sums of money he received from developers and other business people.
Redmond told the tribunal much of the proceeds where held in an assortment of bank accounts, often under assumed names. He also retained large sums of cash in his home. circulating
