Three men used a sledgehammer to burst into a woman's bedroom and throw her out of the flat she shared with her partner, it was claimed in the Circuit Civil Court yesterday.
Judge Liam Devally was told Ms Ashley McGoldrick was still being treated for distress and shock and had to wear a neck support because of injuries she received at the hands of one of the men.
Ms Caroline Kelly, counsel for Ms McGoldrick said Ms McGoldrick and her partner, Mr Gary Keating, who was suffering from a life-threatening illness, were seeking to be reinstated in their £360-a-month one-bedroom flat on the North Circular Road, Dublin.
They also wanted an order restraining the landlord, Mr Thomas Butler, of The Park, Abbey Farm, Celbridge, Co Kildare, from interfering with them.
Ms McGoldrick told the court in an affidavit that she and Mr Keating moved in together last June and shortly afterwards Mr Butler had become antagonistic towards them and in August demanded they vacate the flat.
"He verbally threatened us and later threatened force and acts of violence," she said.
Judge Devally granted them leave to serve short notice on Mr Butler notifying him of the court reliefs they were seeking.
