Work is to resume on three of eight building projects that are part to the regeneration of Ballymun, the High Court was told yesterday.
On the consent of both the National Authority for Occupational Safety and Health and Ballymun Regeneration Limited, Mr Justice McCracken agreed to vary an interim order that had prevented work, apart from safety and remedial works, on eight separate building projects in Ballymun.
The judge was told a formula was agreed between the parties under which the authority could consent to the resumption of work at three locations - McCabe Builders, Poppintree 1 A, Ballymun; McInerney Construction Limited, Coultry 2A, Ballymun and Harvey Contracting Service Ltd, Silogue 2A, 2B and 2C, Ballymun.
He varied his interim order of October 9th to that effect and granted both sides leave to apply to the court on 24 hours notice.
The interim order, with the variations agreed, continues to Thursday next when the matter will again come before the court for mention with a view to fixing a date for the hearing of an application for an interlocutory order.
If the interlocutory application proceeds and such an order is granted, that order will apply pending the determination of proceedings between the authority and BRL.
When the matter was initially mentioned yesterday, Mr John Gordon SC, for BRL, said both sides had agreed the case could be put back for another week for mention only with a view to getting a date.
When the matter again came before the judge, he was told of the formula agreed between the sides that would allow work to resume on the three sites.
At the request of BRL, work on the project initially stopped voluntarily on September 28th, after the death of a four-year-old boy who was hit by a construction vehicle.
