Sir, I note Mr Herman's letter (September 24th) under the heading "Visitors and Trespassers". I wish to make three points. Firstly, I suggest it would only be fair for Mr Herman to quote accurately where he intends a quotation to support his point of view.

Secondly, I am surprised if he is unaware of legal actions inside and outside the courts against occupiers under the former legislation. Thirdly, the main point of my previous letter was to show that under the new Occupiers' Liability Act, occupiers are still left with a very high duty of care towards entrants. One way of reducing (not removing) that level of care is for property occupiers to erect an appropriate sign as advised by the Act.

Advising farmers to use the terms of the Act to reduce their potential liabilities hardly deserves Mr Herman's cryptic comment. Presumably he does not allow unauthorised entry to his own house. However, if some of your correspondents want to apply their own vested interpretations to parts of the Act, generally speaking there is little anyone can do to prevent them.
