Button finished third in the San Marino Grand Prix but faces disqualification after a post-race check found a hidden fuel compartment inside the main tank.
Button's BAR-Honda was found to be five kilograms below the minimum weight imposed by the FIA, although race stewards declared the results official after six hours of discussions.
The FIA were unhappy with that decision and will appeal it, with BAR forced to explain why their car was raced under the weight limit.

TENNIS: Australian Open champion Marat Safin overcame a shaky start to beat Jiri Novak of the Czech Republic 6-7, 6-1, 6-1 in the first round of the Rome Masters yesterday.
The second seed established a 4-1 lead but unforced errors started to creep into his game, allowing Novak to break twice and serve for the set.
Safin rallied to force a tie-break, but some more wayward shots gifted the set to his opponent. For a moment it seemed the Russian might be heading for another early exit, but he closed out the second set in just 26 minutes. The Australian's dominance continued in the deciding set.
Safin was joined in the second round by ninth seed Guillermo Coria, who took almost three hours to beat Chile's Fernando Gonazalez 7-6, 5-7, 6-4.
TENNIS: Former world number one Kim Clijsters took just 44 minutes to knock out Ukraine's Yuliana Fedak 6-1, 6-0 at Berlin's Steffi Graf stadium yesterday and reach the second round of the German Open.
Clijsters, now ranked 17th in the world, broke Fedak's serve in the first game and converted two more break points.
Fedak looked outclassed as 21-year-old Clijsters immediately broke serve in the second set and dominated to the end.
Earlier, former world number five Daniela Hantuchova was bundled out of the tournament, beaten 6-4, 6-4 by Argentine 20-year-old Gisela Dulko.
