A new appeal by Michael Kinane to the Turf Club's appeals and referrals committee is set to be heard on Monday in front of a new panel.

A High Court hearing into Kinane's interim injunction was resolved in the jockey's favour in Dublin yesterday and the appeals process will begin again at the Turf Club headquarters on the Curragh next week.

Kinane was granted the injunction on the eve of Galileo's appearance in the King George VI & Queen Elizabeth Stakes last month following the dismissal of his original appeal against a two-day ban for careless riding.

That injunction was granted after the court agreed that Kinane's legal team at the original appeal were not allowed to make a plea of mitigation to the referrals committee. The High Court yesterday settled in the jockey's favour and the appeal dismissal is null and void.

The Turf Club chief executive Brian Kavanagh said after the hearing: "In the circumstances, it is a satisfactory outcome. The new hearing will be held on Monday, the 27th, if possible, or as soon as possible thereafter." A new panel, that will replace the original three man board, will have to be formed and witnesses organised.

The Turf Club's Inspector of Courses, Bill McLernon, has passed the Punchestown racetrack fit for racing and the Co Kildare course will be able to resume racing on Sunday, September 30th. A drainage problem has resulted in no racing at Punchestown since October 9th last year.

Pat Smullen and Dermot Weld were out of luck with Mutakarrim in yesterday's Ebor at York but should resume the winning habit at Gowran today.

Stylish Icon, third to Camp David on her Naas debut, can score in the first division of the mile maiden and judged by the all-round quality of Weld's juvenile fillies, the Sadlers Wells newcomer, Ripple Of Pride, has to be respected in the second division.
