British Horseracing Board chairman Peter Savill yesterday lost his appeal against the York stewards' decision not to promote Pepperdine to first place in last Saturday's Coral Sprint Trophy.
The Jockey Club disciplinary committee upheld the original result, leaving Get Stuck In the winner despite hanging across the course.
John Maxse Jockey Club spokesman, said: "The committee did not feel that there was evidence to suggest that Pepperdine would have definitely won but for the interference."
Kieren Fallon said: "I should have got the race on Saturday and I'm not surprised that we haven't got it today."
