Lawyers for Wayne Dundon have asked the Special Criminal Court to adjourn his forthcoming trial on a charge of murdering local businessman Roy Collins five years ago.
Wayne Dundon (35), of Lenihan Avenue, Prospect, Limerick and Nathan Killeen (23), of Hyde Road, Prospect, Limerick are charged with the murder of Mr Collins (35) at Coin Castle Amusements, Roxboro Road Shopping Centre, Limerick on April 9th, 2009.
They are due to stand trial on April 29th next.
Counsel for Dundon, Remy Farrell SC, this morning applied to adjourn the trial as he said there was "little reality" of the trial concluding in the four to five weeks set aside.
He told the court there were also issues surrounding the disclosure of the evidence in the case.
Counsel told the court that the defence intended to go to the High Court to seek judicial review with regard to this and other evidence.
Keith Spencer BL, for Killeen, said he wished to make a similar application.
Counsel for the prosecution, Sean Guerin SC, told the court that any adjournment of the trial would give rise to very serious concerns in relation to the security of a number of witnesses.
He said evidence in relation to this was available and asked the court to put back its consideration of the matter to enable examination of the witness testifying as to the security issue.
Presiding judge Mr Justice Paul Butler said the court had not come to any decision and would adjourn the application until February 14th.
He remanded the accused men in custody to appear before the court via video link on that date.
