The High Court has granted a temporary injunction preventing the deportation of a west African father of twins who contracted tuberculosis while detained in an Irish prison.

The man, a Ghanaian national who is the father of three-year -old twin boys, had been ordered to report to the Garda National Immigration Bureau and that his deportation back to his home country was imminent.

Yesterday, Mr Justice Garrett Sheehan was told the man has been receiving medical treatment for TB, which he and a number of other prisoners contracted while they were detained in Cloverhill Prison, Dublin. Lawyers acting for the man sought the injunction as it is intended to bring judicial review proceedings arising out of the State’s refusal to rescind the order for the man’s deportation to Ghana.

The court heard that as the man and the mother of the twins come from different countries (the mother is from the Cameroon) the deportation order would have the effect of breaking up their family and would result in the children losing one or other of their parents. Mr Justice Sheehan in granting an interim injunction made the matter returnable to next Wednesday’s sitting of the High Court.
