A fresh application is to be made next Monday to obtain a drinks licence for an open-air concert in Dublin's Liberties on New Year's Eve.

An attempt to get an occasional licence to serve drink at Newmarket Square for the concert - featuring stars of the Commitments and Shane McGowan - was withdrawn yesterday.

Mr Paul Griffin, a local publican, said the concert will go ahead with or without a licence.

Discussions are to take place about obtaining an indoor venue, possibly a factory premises, as a bar rather than the original idea of holding it in the open air.

Gardaí have objected to the drinks licence, saying they will not be in a position to police the event on what is the busiest night of the year for them.

Sgt Joe Carroll told Dublin District Court yesterday the city council had refused to temporarily rescind the by-laws which ban drinking in public.

Judge Bridget Reilly, who had adjourned the case to yesterday to consider a plan drawn up by the organisers, said an amended application for a licence would have to be made before another judge.

The idea for the concert came up after a number of other New Year's Eve events for the city,including a street party in O'Connell Street for the unveiling of the Millennium Spire, were cancelled.

Newmarket Square was once used for a fruit market and may be designated in the city development plan as civic open space.

Gardaí say residents are objecting and concerned about access for emergency vehicles through the narrow streets leading to the square.

The concert will be an all-ticket affair limited to 4,800 people.
