A director of a Chinese restaurant breached a tenancy clause by setting up residence in the office, Dublin Circuit Civil Court was told yesterday.

Judge Michael White was told that Mrs Cheung, a director of the Imperial Chinese Restaurant Ltd, Wicklow Street, Dublin, had established and maintained her home in an offices at the rear of the restaurant but had now moved out.

After Judge White ruled in favour of the landlord on a legal point of jurisdiction, Mr Ronan Murphy, counsel for the restaurant, said his client would no longer be relying on claims that the landlord had permitted or acquiesced to the office being used as a residence.

Judge White struck out the application for possession and granted an order for £2,225 rent arrears and costs to the plaintiff.
