The High Court has continued for another week an order restraining the deportation of a Romanian national from the State.
Mr Gheorghe Gageanu, with an address at Talbot Street, Dublin, was last week given permission by the court to seek an order quashing the ministerial deportation order made on October 30th last.
Mr Justice Peter Kelly also made an order restraining until yesterday the deportation of Mr Gageanu, which was due to be put into effect last Friday.
Mr Justice Geoghegan yesterday agreed to continue that restraining order for another week.
At the earlier hearing it was stated that Mr Gageanu had been taken into custody last Wednesday. He said he had been refused asylum a year earlier by the French authorities and had returned to Romania. He said he arrived in Ireland from Romania last February through Waterford port, having paid £1,000 to travel in a container on board a ship.
Mr Gageanu applied for asylum last July, but was told by the Department of Justice, Equality and Law Reform that the French authorities were dealing with his application and that France had been his first port of entry.
He appealed that decision and had advised the Department that he had come directly from Romania and not through France.
He had received an acknowledgment but no further communication regarding a decision on his appeal until he was detained by police last week, the court was told.
Mr Justice Kelly said a sufficient case had been made to grant Mr Gageanu leave to seek an order, by way of judicial review, to have the Minister's deportation order quashed. It is understood that, since the court orders were made, Mr Gageanu has been released from custody.
