A Nigerian student who is due to begin his Leaving Cert tomorrow will be allowed to complete his exams before a legal row over his deportation order is concluded.

In the High Court today lawyers for Minister for Justice Michael McDowell agreed not to deport the student, pending the outcome of a legal challenge to that deportation order.

Tunde Yinusa Omoniyi (20) is seeking leave to bring a judicial review challenge to the deportation order which he received two weeks ago.

Mr Omoniyi is a student at Palmerstown Community School in west Dublin and is a friend of Olokunle Elukanlo, whose deportation to Nigeria three months ago resulted in a major campaign that led to his return to sit the Leaving Cert.

The case has been adjourned until July 4th.
