THE HEAD chef at a Dublin city restaurant has been given permission by the High Court to seek an injunction to prevent his dismissal from his position.
Ms Justice Mary Laffoy was told yesterday that Tom Doyle, who is head chef at the ely-hq restaurant at Hanover Quay in Dublin's Docklands, was dismissed late last week after he refused to waive any rights in relation to recipes included in a cook book being produced by his employers.
The judge gave Mr Doyle (28), Rathfarnham, Dublin, permission to bring proceedings against Asilo Commercial Ltd, Wentworth, Eblana Villas, Dublin, aimed at preventing his purported dismissal from his position.
Oisín Quinn SC, for Mr Doyle, said his client was verbally dismissed following a disciplinary meeting held last Friday.
Mr Quinn said Mr Doyle was dismissed after he refused to sign a waiver in relation to rights over a number of recipes included in a cook book put together by his employers. Mr Doyle claims a number of recipes in the book are his creations.
The judge also granted Mr Doyle an interim injunction ( on an ex-parte - one side represented - basis) preventing his employers from publishing and or communicating he has been terminated from his position. The case was returned to later this week.
Mr Doyle has been employed at the restaurant for the last 2½ years. ely-hq, along with ely chq, Custom House Quay, and ely winebar, Ely Place, Dublin 2, are part of a chain of well-known restaurants in Dublin's city centre.
