A Dublin woman who faces losing her home for alleged "anti-social behaviour" is to mount a High Court challenge against Dublin Corporation, which is seeking to evict her.
The corporation had sought a warrant for possession of Ms Michelle Kelly's apartment in St Joseph's Mansion, Dublin. Mr Ronan Murphy, counsel for Ms Kelly, told the President of the Circuit Court, Mr Justice Esmond Smyth, that the notice to quit had been properly served on his client but it was her intention to seek judicial review on the grounds that a full review of her circumstances had not been made.
He said that for more than two years, until August 1996, Ms Kelly had been married to Mr Noel Kelly who had been charged with a drug offence. There had never been any allegation against Ms Kelly and she had not come to the notice of the gardai.
Mr Justice Smyth adjourned the repossession application to allow Ms Kelly to seek leave for a judicial review by the High Court of Dublin Corporation's decision on the grounds that her personal circumstances had not been fully considered by it.
