AN ATTEMPT to overturn the UK bankruptcy of Priory Hall developer Thomas McFeely will be heard in England this week, the High Court in Dublin was told yesterday.
Lay litigant Theresa McGuinness told Mr Justice Peter Charleton the case would be heard at the High Court in London on Friday.
Ms McGuinness, of Rush, Co Dublin, is attempting to have Mr McFeely’s UK bankruptcy reversed on the basis she had begun bankruptcy proceedings against him in Ireland before he filed for bankruptcy in the UK.
The regime there is less stringent than in Ireland and Mr McFeely could emerge from bankruptcy in 12 months.
Ms McGuinness took her case in the autumn of 2011 after Mr McFeely failed to pay a court award of over €100,000 in damages made to her in 2009 against his company, Coalport Ltd.
She was awarded the damages against Coalport after it emerged that a house she had bought had serious structural defects.
She has also claimed she was owed an additional €200,000 in costs arising from her 2009 court action.
Mr Justice Charleton adjourned the case until July 23rd.
