Right of Somali national to naturalisation information affirmed
A Somali national who had been granted full refugee status but whose application for a certificate of naturalisation was rejected applied to the Department of Justice, Equality and Law reform for an explanation of the decision. However, he was refused on the grounds that there was "no obligation" on the Minister under the citizenship Acts to provide reasons for such decisions. But the Commissioner said there was "a fundamental flaw" in the Department's argument. Affirming the man's right to a statement of reasons, she said the furnishing of such a statement "in no way made any inroad into the discretion vested in the Minister by the citizenship Acts".
