The Barr tribunal has been adjourned for a third time this week to allow Judge Robert Barr to consider whether Dr David Shanley, psychiatrist to the late Mr John Carthy, should be recalled to the stand.
Mr Carthy was suffering from manic depression when he was shot dead by gardaí outside his home at Abbeylara, Co Longford, in April 2000.
Dr Shanley gave evidence to the tribunal at the beginning of April but is likely to be recalled following remarks by the chairman earlier this week that gardaí should have brought the psychiatrist to Abbeylara the night the siege began.
Dr Shanley did not arrive at the scene until the following day, shortly before Mr Carthy was killed, and never had an opportunity to speak with his patient.
On Wednesday, counsel for the gardaí, Mr John Rogers, submitted that Dr Shanley should be recalled. He believed the chairman was suggesting that the Garda negotiations "were doomed" from the outset because Dr Shanley was not at the scene.
Counsel for the Carthy family, Mr Patrick Gageby, said he would also like to examine Dr Shanley about an earlier suggestion that Mr Carthy had been attempting to commit "suicide by cop".
In his report to the tribunal yesterday, tribunal counsel, Mr Michael McGrath, agreed that Dr Shanley should be recalled before any further evidence is heard.
Judge Barr is to give his decision on the report this morning.This is the fifth time in less than two weeks that the tribunal has been adjourned.
