The Minister for Communications, Marine and Natural Resources, Noel Dempsey, has asked the High Court for orders removing a slipway and moorings constructed by Walton Court Limited at Oysterhaven, Co Cork.

The Minister is seeking a permanent injunction directing the company to remove the slipway, which is allegedly not in accordance with approved plans, and to ensure that any replacement is in accordance with the plans and drawings in the foreshore lease dated September 25th, 2003, granted to Walton Court for the purpose of constructing and maintaining a slipway.

Walton Court Ltd is seeking a dismissal of the proceedings on grounds of gross, inordinate and inexcusable delay.
