A man accused of sexually assaulting two girls in Tallaght when he was aged 11 years will face trial in the Circuit Court, Tallaght District Court in Dublin heard yesterday.
The 29-year-old man, with an address in Tallaght, who cannot be named for legal reasons, is charged with five counts of sexual assault between February 17th, 1988, and December 31st, 1990, in Tallaght.
The man is also charged with four other counts of sexual assault on the same dates and at the same location in Tallaght.
Sgt Bernard Jones gave evidence of arrest, charge and caution by certificate to Judge James McDonnell.
Solicitor for the Director of Public Prosecutions, Domhnall Forde, told Judge McDonnell that the DPP had directed trial on indictment. The accused man's solicitor Gráinne Malone said her client was originally arrested in August 2004 and questioned and had now been charged nearly two years later.
She asked the judge to stick to the letter of the law in regard to the time allowed for service of the book of evidence (42 days).
She also said the offences of which her client was accused were alleged to have happened when he was 11 years of age.
Judge McDonnell remanded the man on continuing bail for four weeks for service of the book of evidence.
He said if the book of evidence was not ready on the next date, he would be seeking an explanation from the State as to why it was not ready.
