A man who suffered serious brain injuries when he was struck by a Luas tram as he crossed the tracks with a high level of alcohol in his blood has been awarded €650,000 damages at the High Court.
Derek Cross (52) suffered a traumatic brain injury, multiple rib fractures and damage to the left side of his body when he was hit by the tram.
The High Court heard Mr Cross had been drinking and had a very high level of alcohol in his blood as he crossed the tracks at the Red Cow Hotel to get a taxi home on September 15th, 2007.
Mr Cross, Old Church Close, Nangor Road, Clondalkin, who had worked as a painter and decorator, sued South Dublin County Council, the operators of the Luas tram line the Railway Procurement Agency, Veolia Transport and Connex Transport as a result of the iccident.
He claimed the defendants failed to design, construct or provide a safe layout of Luas line or track with appropriate signage and safe access for pedestrians.
Approving the settlement yesterday, Ms Justice Mary Irvine said it involved an exceptionally good offer.
