Tánaiste Mary Harney has backed the proposed deportation of the Nigerian student Kunle Eluhanla.
"Whether it is mine or any other member's constituency, the law must apply without fear or favour," she told Socialist TD Joe Higgins.
The Dublin West TD had asked Ms Harney to intervene with Minister for Justice Michael McDowell to "turn away from" putting the student, his classmates and the people of Palmerstown in Dublin "through the ordeal and torture of another deportation attempt".
The student was deported to Lagos last year but allowed to return to sit his Leaving Cert and given a six-month extension. He received a letter earlier this week notifying him that he would be deported within a fortnight.
