A US appeals court today dismissed a government appeal to prevent accused September 11th conspirator Mr Zacarias Moussaoui from questioning a captured al-Qaeda operative.

The three-judge panel in Richmond, Virginia, concluded it did not have authority to hear the government's appeal because the district judge's order allowing access to a captured al-Qaeda member "is not yet an appealable one."
